Residency Requirements
Either you or your husband/wife must have been Texas residents for six months or more to qualify for a divorce. The petitioner (party who files for divorce) must also have been living in the county where the filing takes place for 90 days or more.
Reasons for Divorce in Texas
Fault bases for divorce include:
- Adultery
- Abandonment
- Conviction of a felony
- Cruelty or abuse
But Texas is a no-fault state, so you and your spouse may claim an insupportable marriage as sufficient grounds for the divorce.
There’s no reason to go through the formalities of a fault-based divorce. You can prevent family dissension and the public airing of your family issues by avoiding a formal divorce. Paperwork for no-fault divorce will be provided.
Parenting Issues
Contrary to some states, the courts of Texas support the involvement of both parents after a divorce. This is known as Joint Managing Conservatorship. In most cases, the child or children will live with one parent while being visited by the other.
Parents may draw up an agreement stating their visitation wishes. You will also receive a Standard Possession Order from us, which is a legal parental agreement that’s highly favored by the courts of Texas.
Child Support
Child support depends on how much the paying parent earns. The state of Texas has guidelines for determining child support, but you and your spouse may customize the agreement to suit your needs if you so wish. The courts will usually accept such agreements if they are fair.
We also have a calculation tool which gives you an estimate of how much child support you will pay (based on the information you enter and the court’s requirements), although it is not a replacement for legal advice.
Filing Fees
Remember to ask your county’s court officer about filing fees, since our fee excludes court filing fees—which differ from county to county.
