Residency Requirements

The State of Kansas calls for one of these requirements for the Plaintiff to file divorce papers:

  1. Either the Plaintiff or Defendant should reside in the state for no less than 60 days
  2. OR

Reasons for Divorce in the State of Kansas

The courts here recognize both no-fault and fault-based reasons. The no-fault ground for divorce is incompatibility. The fault-based grounds include:

  • Mental insanity
  • Refusal to engage in sexual interactions or abandonment
Parenting Issues

The best interests of the child are the main governing factor in determining custody. Both parties should agree upon the joint or sole custody and provide a written agreement. The court will pass a verdict depending on the agreement and the child’s wishes if s/he is mature enough.

Child Support

For the most part, the courts give judgment on the child support payments according to the accepted guidelines. When calculating the amount of the support the officials will check both parents’ gross incomes and the child-related expenses. The non-custodial parent will pay support until the child’s 18th birthday or their high school graduation.

Venue

Note that Coffey County does not accept divorce packets for parties that are not represented by attorneys. That is why our service cannot offer packets of documents for this county.

Filing Fees

Remember to ask your county’s court officer about filing fees, since our fee excludes court filing fees — which differ from county to county.
