Residency Requirements

The petitioner should have been a resident of the State of Hawaii for no less than three months. However, the finalization of the divorce is possible only when at least one spouse has no less than six months of residence in the state.

Reasons for Divorce in the State of Hawaii

No-fault grounds are the only legal grounds for divorce in the State of Hawaii. These are:

  • An irretrievable breakdown of the marriage
  • Living separate and apart without cohabitation for two years
  • Legal separation without reconciliation
Parenting Issues

The courts here award sole or joint custody when it comes to the best interests of the child. As a rule, the court appoints joint legal custody, meaning that both parents can participate in the decision-making regarding child’s well-being. There are sole and joint physical custody; in the first case one of the parents becomes the primary residential custodian and the child spends most of their time with this parent. Joint residential custody is also possible if agreed upon or awarded by the court. The child’s wish to live with certain parent is also taken into consideration if he or she is mature enough.

Child Support

For the most part the child support is calculated according to the income of both parents and child-related expenses. The payments continue until the child comes of age and may be prolonged until their high school graduation.

Venue

The divorce should be filed with the Family Court of the circuit in which the applicant has resided for at least a three-month period.

Filing Fees

Remember to ask your county’s court officer about filing fees, since our fee excludes court filing fees — which differ from county to county.
