Residency Requirements

To be able to file for divorce a filing spouse should have been a resident of Colorado for no less than 90 days. Another 90 days should pass between serving the defendant and finalizing the divorce.

Reasons for Divorce in the State of Colorado

The courts here recognize only irretrievable breakdown of the marriage as a ground for divorce. Any other ground won’t be accepted.

Parenting Issues

Initially both parties have equal rights in the arrangement of custody. If the divorce is contested, the court will define the parenting time and what part in the decision-making concerning the child’s well-being each parent will have.

Physical custody is defined according to the wishes of the parent and the child if he or she is old enough. Here much importance is given to the wish of the residential parent to encourage meaningful and frequent communication of the other parent. The amount of the support is determined by special forms taking into account the gross income of both parents and child-related expenses. For the most part the payments continue until the child’s 18th birthday or until high school graduation, whichever occurs first.
