Reasons for Divorce in the State of Arkansas
There are several acceptable grounds for divorce in the Arkansas courts:
- Separation of the spouses for more than one and a half years (no-fault)
- Living separately without cohabitation on a voluntary basis for more than 3 years (no-fault)
- Legal cruelty (fault)
- Adultery (fault)
- Impotence (fault)
- Conviction of a felony
- Habitual drunkenness for a period of no less than one year that has led to cruel or inhumane treatment that endangered the life or health of the other spouse or has led to intolerable conditions due to the neglectful treatment
Parenting Issues
The best interests of the child are the determinant with regards to custody. The court does not give preference based on the gender of the parent. Following the guidelines the court will make sure that the decision about the custody will provide the best options for a child with frequent and meaningful contact with both parents.
Child Support
For the most part the amount of the support is calculated according to the gross income of the parents and child-related expenses. The payments continue until the 18th birthday of the child and may be extended until high school graduation.
Filing Fees
Remember to ask your county’s court officer about filing fees, since our fee excludes court filing fees — which differ from county to county.
